They allege that the new chief, Ross Swimmer, has control over tribal funds and has interests in corporations doing business with the Cherokee Nation. The lawsuit also claims that election committee members favored certain candidates, destroyed ballots, and failed to keep proper records. The defendants named in the lawsuit include former Chief W. W. Keeler, election committee members, and BIA agency superintendent Joe Ragsdale. The plaintiffs argue that their rights to equal protection and lawful privilege to vote were violated. The downstream portion of the riverbed is still in litigation between different tribes. Expert appraisers have estimated the total damage to be $42,494,536.40. The Army's general counsel will prepare a report for submission to the comptroller general, who will then decide whether a Certificate of Settlement should be issued for payment by Congress. The Cherokee attorneys acknowledged the government's honest mistake regarding ownership of the riverbed. Bartlett regarding Mr. and Mrs. Burris's request for access to the rolls of the Cherokee Nation to determine their degree of Indian blood. The Burris's claim to be of Cherokee descent and have been unsuccessful in obtaining assistance from the Bureau in researching their ancestors. Senator Bartlett enclosed information provided by the Burris's and requested cooperation and assistance from the Department of the Interior in this matter. Text
